项目摘要

本年度は、6月26日に、オンライン会議で今年度の研究会の方針を決めたうえで、昨年度に引き続き、アメリカ・ドイツ・フランスの法状況や日本法の検討を行っている。これまでの研究成果を共有するための研究会をオンラインで開催した。9月6日に、研究分担者である重本氏が、ドイツの水法における「悪化防止原則」の展開を紹介し、国・自治体の洪水防止責任との関係を検討した。また、近藤氏が、日本の水害訴訟に関する最近の判例を検討し、判例理論の現状がどのようになっているかを明らかにした。2023年2月21日には、研究分担者である髙田氏が、洪水対策の観点から見たドイツの水害防止法制に関する最近の動向について、現地の体験に基づく検討を行った。また、嘉村氏が、保険法の知見に基づき、日本の水害保険の保険料率に関する分析を行った。重本氏の研究により、ドイツでは、水害防止を含む水の問題について国を縛る一般原則を立てることによって対応していることが示された。髙田氏の研究により、ドイツでは、水害対策に必要な施設整備の財政・土地収用の扱いについて、日本の扱いと異なる点があることが示された。近藤氏の報告により、ハザードマップの整備と行政責任の関係をどのように考えるかが課題となっていることが示された。嘉村氏の報告により、現在任意の民間保険として運用されている日本の水害保険を批判的に検討する見解の分析が行われた。昨年度の途中段階での研究成果に基づき、重本氏、福重は、下で示すように、当年度に慣行された書籍に、ドイツ、ＥＵ、フランスの水関係法の記事を公表した。近藤氏も、昨年度の研究に基づき、法律学系の雑誌に論文を公表した。
