本研究は、市場支配力を持ったデジタルプラットフォーム事業者の行う競争制限行為(特に排除行為)を念頭に置きつつ、これに対する独占禁止法の要件解釈を発展させ、精緻化することにより、積極的な法運用を理論的に支える学術研究の水準を引き上げることを目的とするものである。具体的には、デジタル経済の文脈から先例等から解釈の再発見を行うとともに、EU競争法との比較法的研究を軸としつつ、解釈運用あるいは立法政策に関する示唆を得る。課題2年目に当たる本年度は、デジタルプラットフォーム事業者による課金方法の拘束が問題となったアップル・インク事件 の評釈（令和3年度重要判例解説：ジュリスト1570号）、初めての私的独占課徴金事件となったマイナミ空港サービス事件の評釈（公正取引861号）、最恵国待遇条項（MFN条項）に関してデジタル市場における同等性条件の違法性判断を分析した論考（NBL 1239号）などが研究成果として公刊された。また、第20回法と経済学会全国大会にてシンポジウム 「購買力・買手市場支配力」のモデレーター、公正取引委員会 競争政策研究センターが主催する第21回 国際シンポジウムの講演者・パネリストを務めるなどした。本研究課題に密接に関連する新論点として、デジタルプラットフォーム透明化法とEUのデジタル市場法（DMA）に関する研究を鋭意進めており、神戸大学プラットフォーム科研研究会や早稲田大学プラットフォーム科研研究会、一般社団法人日本新聞協会などでも、透明化法やDMAに関する研究報告を行った。こうした研究成果は、自民党政務調査会で事前規制の意義と内容を報告するなど、政策形成にも貢献している。
