本研究は、社会的重要度を増したデジタル・プラットフォームに係る競争上の問題のうち、プラットフォームの競争力に深く関係する個人データの収集や利用から生ずる諸問題に焦点を当て、とりわけ、①個人データの不当な収集・利用に対する協調的規制、②個人情報保護と競争促進という異なる要請に伴う相克の調整、③パーソナライゼーション加速化傾向に伴う取引の個別的差別化への対応、という３つの問題をにつき、競争法上の単独行為規制を中心に、個人情報保護法や消費者法等他法の観点も包括して、我が国における適切な規制政策を提言し得る理論的基盤を提供しようとするものである。１年目は、当初の計画通り、予備的研究が進んでいる①②の問いを中心に、現在生じている問題事象を正確に把握しながら、比較法の観点から法規制政策の動向を、背後にある社会的政治的背景と関連付けながら、抜本的に理解するよう文献収集と読み込みを行った。研究計画においては、上記問題に対して積極的規制政策を展開するEUとその加盟国等の動向を中心に研究を進める予定であったが、政権交代後のアメリカ合衆国における政策動向も注目されることから、アメリカの規制政策動向についてもかなり立ち入って研究を進めた。このようなアメリカ競争法規制政策の変化とその背景に関する整理の作業の中から興味深い分析を得られたことから、それを論文の形でまとめ、近く公表される予定である。一方、個人情報保護法、消費者法の検討については昨年度に十分手が回らなかったため、本年度研究に着手する予定である。
