项目摘要

本年度は、2022年5月に開催された日本刑法学会第100回大会のワークショップ「経済刑法」（デジタルプラットフォーム事業者がもたらす競争政策上の諸問題と刑事規制）に向けて所要の準備を進めるなかで本研究の進展を図るとともに、ワークショップ修了後は、ワークショップでの質疑を踏まえ、研究をさらに深めた。ワークショップでは、市場における経済活動に対する規制の状況について、市場の機能に着目してこれを侵害ないし危殆化する行為を規制しようとするものと、市場における他の競争事業者や消費者の具体的利益に着目してその侵害ないし危殆化を規制しようとするものとに大まかに分類可能であることを明らかにし、自己優遇や搾取行為など、デジタルプラットフォーム事業者（以下、DPFという。）がもたらす競争政策上の諸問題について刑事規制のあり方を考える場合にも、個々の問題の経済犯罪規制における理論的位置づけを明らかにすることが肝要である、との視点を示した。そのうえで、DPFに対する刑事規制のあり方について、独占禁止法の運用をめぐる課題を明らかにしつつ、刑事立法の方向性について検討を行った。なお、研究の成果は、岡山大学法学会雑誌72巻3・4号に「デジタルプラットフォーム事業者による競争侵害行為と刑事規制－独占禁止法の罰則の検討を中心に－」として掲載した。DPFに対する刑事規制をどのように考えるかについては、「経済刑法」の体系的整序を図り、解釈論と立法論とを接続する経済刑法の統一的視座を明らかにすることにより、経済活動の規制の領域における刑事規制の導入基準を明らかにする、という本研究の意義が正面から問われており、経済刑法における法益論の意義、行為規制の比例性を含めた行為規範の正当化基準（刑事立法のあり方）、行為規範の不確定性をめぐる問題も含め、個別経済刑罰法規の解釈論的諸問題の検討を通して、研究をさらに深化させた。
