项目摘要

2011年度は、内外の文献収集にあわせ、研究者へのインタビューを行い、また研究成果を公刊した。特に、この数年で、経済事犯の代表的犯罪である背任罪について重要な判例が立て続けに、数多く出されているドイツの状況について、単なる紙媒体の資料収集にとどまらず、ドイツに赴いて、著名な刑法研究者数名にインタビューをし、貴重な意見を聞くことができた。研究成果としては、背任罪の実行行為である任務違背行為の概念について、近時の重要な判例である最決平21・11・9刑集63巻9号1117頁(北海道拓銀事件)をふまえ、さらに、歴史的、比較法的見地からこの概念に分析・検討を加えた「背任罪における任務違背行為」『植村立郎判事退官記念論文集・現代刑事法の諸問題・第1巻』(2011・立花書房)があり、また、昨年度、本研究費をも用いて招聘した、ミュンヘン大学のベルント・シューネマン教授による講演の邦訳「いわゆる金融危機～司法への挑戦か」が、刑事法ジャーナル30号92頁以下に掲載されている(翻訳は山中友理・摂南大学講師であり、同103-104頁に研究代表者によるコメントが付されている)。同時に、日本法の現状をドイツおよびドイツ法系の諸国に伝達することにも努め、未公刊であるが、Der subjektive Tatbestand der Untreue im japanischen Recht(日本法における背任罪の主観的構成要件)を、インメ・ロクシン博士65歳祝賀論文集に執筆した(2012年5月刊行予定であり、来年度の研究成果に掲載予定である)。
