1,本研究の目的は、日本及びフランスの経済犯罪の現状と、具体的対策としての立法、立法の背景となった、あるいは立法から導かれる経済刑法理論の特色、各国の事情に応じた個別具体性と国情の相違を越えて妥当する理論的普遍性を明らかにすることであった。2,今年度に行った研究から得られた知見としては、(1)日本の「経済刑法」は、様々な捉え方はあるにせよ、広く経済取引に関連する犯罪を対象とし、社会問題にもなった悪徳商法等も重要な研究対象であるのに対し、フランスにおいては、単に経済取引に関する犯罪は(通常の詐欺罪等の伝統的財産犯とさほど異ならないという意味で)「Droit penal economique」と別に分類し、日本でいう「経済刑法」は「Droit penal des affaires」と定義した上で、いわゆる「企業犯罪」を中心に研究されていること、(2)日本でも、消費者保護に関する研究が一段落し、最近の経済刑法研究の重点は企業犯罪対策に移ってきているが、我が国の捜査手法、裁判手続き(いわゆる精密司法)等に問題がある上、刑罰も有効に機能していないなど、様々な問題を抱えており、更に研究を重ねる必要がある、(3)フランスでは、1992年改正刑法典中「法人の刑事責任」を規定する等、経済刑法研究の成果が具体的立法に現れている点で我が国に一歩先んじており、最初の適用判例も最近出たので、他の関連文献と合わせて急速に紹介する準備を進めている。(4)但し、上記フランス1992年改正刑法典中、経済犯罪に関する規定が予定されていた第5部「その他の重罪及び軽罪」が未完成なため、それ以上の経済刑法全体にわたる研究及び紹介は、現在のところ中断を余儀なくされているが、今後も立法作業を追跡し、日本の経済刑法理論に寄与する紹介・研究を継続する計画である。
