本研究は、プラットフォームをめぐる情報法の理論体系を構築し、プラットフォームに関する制度設計の枠組みを提示することを目的とする。そのために、本年度は、以下のように研究を行った。（1）米国データプライバシー保護法案やEUデジタル市場法の内容と関連する議論を検討することにより、プラットフォーム規制における情報法と経済法の関係のあり方を考察した。その結果、プラットフォーム規制のあり方を検討するにあたっては、プラットフォーム事業者が利用者との関係で有する地位や影響力、事業者の規模等を経済法の観点から分析するとともに、プラットフォームを通じて流通する情報やプラットフォーム事業者により処理されるデータの内容・性質、その取扱い方に照らして利用者や社会に及ぼすリスクを情報法の観点から分析した上で、両者の知見を統合する必要があるとの見通しを得た。（2）台湾および韓国の研究者・実務家と意見交換を行うことにより、日台韓のプラットフォームをめぐる法制度・政策の比較検討を行った。その結果、国際的なデータ保護の強化や感染症リスクへの対応など日台韓が共通して直面する課題を明らかにするとともに、偽情報への対応のあり方など各国が置かれた地政学的状況に応じた姿勢の相違も明らかにした。（3）ソーシャルメディアやメタバースなど媒体・メディア毎にプラットフォーム事業者の役割や責任のあり方を各論的に検討した。その結果、利用者や広告主の表現を対象にモデレーションが行われるソーシャルメディアの場合に比べ、利用者等の表現のみならず行為、さらには外部事業者による世界創造を対象にモデレーションが行われるメタバースの場合には、より多様な権利利益やステイクホルダーへの配慮が求められ、政府、プラットフォーム事業者、個々の仮想世界を創造する外部事業者、利用者らによる重曹的なガバナンスの構築が求められるという見通しを得た。

This study aims to construct the theoretical system of information law, and to provide suggestions for the system design. This year, the following research was conducted.
