本研究は、医学研究・診療・健康診断における偶発的所見（incidental findings）ないし二次的所見（secondary findings）の取扱いについて、①本邦における医学研究者・医師の意識と現時点での対応の現状を把握すること、②医学研究者・医師の偶発的所見・二次的所見の取扱いに係る義務を法的観点から検討し理論的枠組みを提示すること、③本邦の医学研究・診療等の現状に即した実践の在り方を提示することを目的とするものである。【1.法的論点の抽出と整理】として、これまでに実施した論点整理、判例調査の結果に基づき、文献調査・研究会開催を通じて法的論点を分析した。また、【2.実態調査における質問紙の作成】として、上記の法的論点の整理や先行調査の分析等を活用して、実態調査における質問紙の作成に着手した。その後、【3.米国等で策定された具体的な指針の精査】として、海外の指針を精査した。なお、【3.米国等で策定された具体的な指針の精査】について付言すると、わが国では、特に診療・健康診断については、ゲノム医療との関係を除けば、具体的な対応策を示す指針の作成は進んでいないと言える。これに対して米国では、ゲノム医療以外の診療についても、具体的な対応策を示す指針が医学団体により作成されている。この点との関係で米国の放射線科医に対して聞き取り調査を実施したところ、施設指針を策定している医療機関も少なくないことに加え、個々の医師等による現場での対応状況や課題の概要を把握することができた。特に患者への説明義務との関係など、現場での課題等について、引き続き丁寧に把握することが重要であると考えられた。
