项目摘要

本研究は、アメリカ民主政が発展・確立する18世紀末から19世紀前半期に頻発した「反乱」を、民衆が独自に構築した人民主権論にもとづくポピュリズム運動ととらえ、その論理と運動の全体像を描き出すことにより、ポピュリズムが合衆国政治文化の基礎形成期に果たした役割を明らかにするものである。その際、本研究では民衆独自の人民主権論とその発現としてのポピュリズム運動（「反乱」）を「異端のデモクラシー」と名付け、そこに内在する革新性と反動性の関連を明らかにしつつ、初期のポピュリズムがアメリカ民主政の展開に与えた影響を解明する。以上の構想のもと、研究三年目にあたる2022年度は、1840年代前半のロードアイランド州で発生した「ドアの反乱」に対する連邦司法の対応を検討した。2021年度に検討したように、ロードアイランド州司法当局はこの「反乱」の首謀者としてトマス・W・ドアを反逆罪のかどで終身刑に処したのであったが、これを不服とするドアは合衆国最高裁判所に自らの人民主権論の正統性を問う訴訟（「ルーサー対ボーデン裁判」）を提起したのであった。この裁判においてドアは合衆国憲法の「共和政保障条項」を根拠に自らの行為の正統性を主張した。すなわち、この裁判は共和政という政治体制が人民主権といかなる関係にあるかを合衆国司法に問うものであったのである。はたして判決はこの問題に対する判断を回避し、ドアの人民主権論の当否にも言及しなかった。このような合衆国司法の態度からうかがえるのは、人民主権の本質を憲法の自由な制定（修正）権とするドアの人民主権論はいよいよ「異端」とみなされるようになっていたということである。以上から、建国後半世紀を経過した合衆国においては、人民による直接的な統治体制の改変を是とする独立宣言型の人民主権論は後景に退いていたことが明らかになった。

This paper studies the development and establishment of democratic politics from the end of the 18th century to the first half of the 19th century. At the same time, this study aims to clarify the relationship between innovation and reaction, the development and influence of democratic politics in the early stage of anti-chaos movement. In the first half of the 1840s, the United States began to investigate the legal response of the United States to the above-mentioned ideas. In 2021, the Supreme Court of the United States filed a lawsuit against the first conspirator of the "anti-riot" case ("anti-riot judgment") and sentenced him to life imprisonment. This judgment is based on the Republican Guarantee Clause of the Constitution of the United States, which advocates the legality of the act.
