项目摘要

2022年度は可能であれば9月にフランス調査に行きたいと思っていたが、コロナ禍と学務の関係でそれが叶わなかったため、引き続き日本の生命倫理をめぐる問題を中心に、国内でできる研究を行った。2020年に成立した生殖補助医療法につき、その制定経緯を調査し、これまでの生殖補助医療の立法化の動きとあわせ、「日本の生殖補助医療法の立法過程――専門家の軽視と国民的議論の不在」を執筆し、金沢法学66巻1号に掲載予定である。なおこの内容は、2023年2月に東京で開催された第14回日仏公法セミナー（XIVeme Seminaire Franco-Japonais de Droit Public）において、"La legislation sur l’assistance medicale de procreation au Japon - Negligence des avis des experts et absence de debat public"と題して報告を行った。さらに、このセミナーにおいてはフランスの生命倫理分野におけるConventionの役割に大いに示唆を受けた。2021年度に医事法学会で報告した安楽死の問題につき、各国法制の医師の良心条項について加筆した上で、2022年9月発行の年報医事法学37号に「安楽死要件を再考する――比較法の観点から」として掲載された。さらに、旧優生保護法下での強制不妊手術をめぐる一連の判例について研究を進めており、近く論文にまとめる予定である。

In recent years, the study of coercive infertility surgery under the old eugenic protection law has been carried out in a series of cases.
