2019年度は、本研究の基本的な視座である、表現の自由に関するアメリカ・モデルの実体的・方法論的特殊性について検討を加え、実体的な特殊性として、差別的表現や名誉毀損の領域において表現の自由をヨーロッパ以上に強く保障する傾向があり、方法論的な特殊性として、表現の自由と公益が対立する場合の裁判所による憲法判断に関して、ヨーロッパでは比例原則という形での利益衡量がなされるのに対して、アメリカではルールに基づく「範疇化」という形での利益衡量がなされていることを明らかにし、アメリカ・モデルの特殊性に関する従来の議論が、没歴史的で文化論的な説明にとどまっていることを具体的に論証する論文を公刊する形で研究を取りまとめた。2020年度は、これを踏まえ、二つの方向で研究を行った。第一は、最近のアメリカにおいて、裁判所はヨーロッパ流の比例原則を用いた利益衡量をなすべきであるとの議論が展開されており、そうした議論の分析を行った。第二は、アメリカ・モデルの特殊性を歴史的に検証するために、ニューディール期から冷戦期を対象として、著名な学者と裁判官の表現の自由論の分析を行った。2021年度は、これまでの研究の結果、アメリカ・モデルの特殊性について、①経済的自由から表現の自由に自由の主たる保護対象が、「二重の基準」論という、極端な形で変化したというアメリカ憲法理論に内在する理由と、②そうした過程においてアメリカはファシズムや共産主義といった「全体主義」国家との対立を余儀なくされたという外在的な理由の、双方が重大な影響を及ぼしているとの知見に至り、その分析を開始した。2022年度は、2021年度の研究を踏まえて、第一次大戦期から冷戦期までのエホバの証人に関わる憲法問題を具体的な対象として、上記①、②に関する研究を行った。
