本研究の目的は、領海および国際海峡における沿岸国の主権と航行の利益・旗国主義との調整に関わる諸論点を検討し、それらが国際法上具体的にどのように調整されているのか分析することを通じて、領海および国際海峡における調整の法構造を明らかにすることにある。計画作成時の予定では、2022年度は、領海および国際海峡における調整の法構造に関する総合的検討を実施する予定であった。しかし、新型コロナウイルスの感染拡大等により当初の予定よりも資料収集および分析が進まなかったため、2022年度は、主として、国際海峡における沿岸国の管轄権と通過通航を妨害しない義務と、無害通航における無害性の判断基準（とりわけ軍艦の無害通航の規制）について調査を進めた。また、法構造の総合的検討を進める前提として、旗国主義についても調査を進めた。これらの調査の結果、少なくとも軍艦の無害通航の規制については、一部の国の国家実行に変化が見られつつあることが明らかになった。また、旗国主義に関しては、近年急速に発展しつつある自動運航船が旗国主義にどのような影響を与えうるかを検討し、論文として公表した。本研究の成果は、理論的には、沿岸国の主権と航行の利益とが現行の海洋法上どのように調整されているのかの解明に資するものであると同時に、実務上は、領海内で沿岸国法令に違反している外国船舶に対し、沿岸国がいかなる措置をとりうるのかを判断する際に役立つものと考えられる。
