占領管理下日本におけるstatehoodの再編成が国内・国際公法理論に影響をもたらした最も典型的な例として、国際法に由来する連合国最高司令官が発する「管理法令」の性格と日本の国家法との関係が注目される。占領終了に向かう中、この処理方法を考える前提として、国内において私人をも拘束する効力を有したこと着目し、それをどのように位置づけ「処理」しようとしたのか、法制官僚を中心とした法実務、宮沢俊義、田中二郎といった有力な公法学者の理論に着目し、分析を行った。これと比較しつつ、占領初期に打ち出された田畑茂二郎の「変型」理論（国際法は国内法に「変型」されなければ国内的に妥当しないという理論）批判の意義を考察した。この研究の一応の成果は、「行政主導の国際法の「変型」体制と「棲み分け」観念による国際法の形而上への捨象」法律時報94巻4号10頁以下で公表したが、この論文について関連研究をすすめている出口雄一教授（当時・桐蔭横浜大学）の意見を求め、また国立公文書館で追加の資料収集を行うなど、引き続き研究を進めている。この関係で、田畑の占領初期にすでに生じた主権否定論から主権肯定論への変化と東京裁判評価の変化に連動性があるのではないか、という仮説に基づき、東京裁判についての法理論の受けとめについて、研究を行い、ソウル国立大学で開催されたワークショップで英語で報告を行った。Statehoodの人的外郭を形成するものとして入国管理法については、引き続き研究をすすめ、日本については、「日本の外国人法史における「在留資格」概念の肥大化」広渡清吾=大西楠テア編『移動と帰属の法理論』岩波書店所収を公表した。日本の状況を客観的に評価するために、国際移住migration国際的議論に参加し、国際的動向をフォローするとともに、比較のためアジア諸国の状況についても編著を準備する過程で情報を収集した。
