项目摘要

本研究は、体制移行直後には新政権の体制の安定を重視して過去の人権侵害の責任追及を行わない判断を下していた国々において、なぜ、1990年代半ば以降、旧体制下で行われた人権侵害の加害者を処罰する試み（人権裁判）が行われるようになったのかを明らかにすることを目的としている。本年度（平成29年度）は、各国における人権裁判実施の原動力となっている国際刑事裁判の法規範の性質について理論的考察を行った。国際刑事裁判の意義については、これまで様々な見解が出され論じられてきたが、現在、理論と実践の双方において中心的な考えとなっているのは、処罰の威嚇によって犯罪を防止するという抑止の論理である。これは今日の国際刑事裁判が紛争終結を待たずに紛争が継続しているさなかに紛争当事者の刑事訴追を行う傾向を強めるにつれて、国際刑事裁判に人権侵害のさらなる拡大と発生を防ぐことが期待されるようになるなかで強調されるようになった考えである。本研究では、国際刑事裁判についての現在の通説的見解である抑止論を批判的に検証することで、国際刑事裁判の法の支配について考察した。具体的には国際刑事裁判の法規範について強制力と規範的正統性の二つの側面から考察することで、国際刑事裁判の法の支配が中央集権的な法の執行体制を志向しているのではなく、規範的正統性を高め、各国の協力と自律的遵守を促す方向で進んできたことを示した。そのうえで、分権的な法の支配を体現する今日の国際刑事裁判が、基本的には主権国家の同質性を前提にしていることを確認し、国際的な重大犯罪者の処罰をめぐる根本的な問題が、国際刑事裁判の法の支配の射程外にある少数の逸脱国の扱いをめぐる政治的課題であることを指摘した。研究成果は日本国際政治学会研究大会で発表し、そこでの議論を踏まえて加筆修正した原稿を、学術誌に投稿した。

This study focuses on the stability of the new system after the system transition, the responsibility of the past human rights violations, and the judgment of the future. This year (Heisei 29), we conducted a theoretical review of the nature of international criminal law norms in various countries. The significance of international criminal adjudication is to investigate the logic of punishment and intimidation, to prevent crime and to prevent crime. The international criminal justice system today has a strong tendency to pursue the criminal prosecution of the parties involved in the dispute. The international criminal justice system has a strong tendency to violate the law. This study is an investigation into the current general theory of international criminal adjudication, the critical theory of inhibition, and the control of international criminal adjudication. The concrete aspects of international criminal adjudication law norms include the coercive force and the legitimacy of norms. The control of international criminal adjudication law, the central centralized law enforcement system, the high legitimacy of norms, the cooperation of various countries and the promotion of self-discipline. Today's international criminal adjudication is based on the premise of the homogeneity of the sovereign state, the recognition of the fundamental problem of the punishment of international major criminals, the scope of the domination of international criminal adjudication, and the political issue of a few escapees. The research results were presented at the Japan International Political Science Society Research Conference and submitted to the Academic Journal.
