项目摘要

本年度は、研究目標に関連して、2本の論文を執筆することができた。1本目は、独立行政委員会制度について検討する「独立行政委員会制度の日独仏比較研究――行政各部編成論第三部――」同志社法学74巻6号（2022年）51-134頁である。本論文では、行政各部の編成方法として、原則形態がヒエラルヒー型であるとすれば、そこから逸脱した例外的形態である独立した機関の設置が、いかなる場合に許容されるのかという古典的論点について、ドイツ及びフランスの議論を見つつ、これまで行政各部について研究してきたところと結びつけて検討している。執筆の中で、すでに十分に指摘されてきたところではあるが、これまで国家行政組織の原則形態とされてきたヒエラルヒー構造からの逸脱が頻繁に見られるようになっていること、しかし、それでも大臣責任の観点からこれがやはり法的な原則形態であること等を確認できた。また、日本において主張されている学説（独立行政委員会設置にあたっての長期的利益の保護という視点）と同様の議論が両国でもなされていることを確認することができた点も一つの成果であった。2本目は、いわゆる分担管理原則と関連して、ドイツにおける所管原理、すなわち各所管大臣による所管領域における独立した職務遂行に関する、「ドイツ連邦共和国基本法における所管原理（Ressortprinzip）の考察」同志社法学太田裕之教授退職記念論集（予定、原稿提出済）である。本論文では、基本方針決定権限を有する宰相、あるいは合議体である内閣との関係で、各所管大臣はどういった権限を有するのかについて、ドイツにおける大臣の役割に関する歴史的制度の変遷を振り返りつつ検討した。本稿執筆において特に興味深かったのは、ドイツにおいても、各省横断的な行政機関との関係で、所管原理がその障害となりうるとする議論が行われていることであった。

This year's research aims are related to the writing of 2 papers. 1."A Comparative Study of the Independent Administrative Commission System: A Review of the Organization of Administrative Ministries, Part III," Gay Social Law 74:6 (2022) pp. 51-134. In this paper, the basic policy decision limit has been set by the prime minister, the collegiate body, the cabinet and the relationship between the ministers, the ministers in charge of the system has been set by the cabinet, the ministers 'service is related to the history of the system has been changed. This manuscript was written with special interest, and the relationship between the administrative organs of the provinces and the principles under their control was discussed.
