今年度においては、前年度における当事者自治の生成・発展に関する歴史研究を踏まえたうえで、さらに現代国際私法における当事者自治の果たす役割について考察するため、その制限法理に絞って研究を進めた。わが国においては60年代以降、当事者自治の制限法理として「強行法規の特別連結」というドイツ法上の考え方が紹介され、その法例への導入の可否をめぐる議論がなされているが、その「強行法規の特別連結」概念は論者によって説明が異なっており、したがってこの議論も必ずしもかみ合っていない。そこで、まず諸外国において「強行法規の特別連結」がどのような理論として理解されているのか根本的に検討しなおす必要があると考えられたため、特にドイツ国際私法における国際的消費者契約における準拠法の決定と強行法規の適用問題に焦点を当てて論稿をまとめた。その検討の結果、明らかになったのは、ドイツにおいては「強行法規の特別連結」という概念が一般に広義で用いられているのに対して、わが国では「強行法規の特別連結」概念に広狭二義あることを的確に指摘することなく議論が進められていた点である。広義の「特別連結」概念に従い、抵触法上の根拠があってはじめて連結がなされると考えれば、法例の解釈論として「強行法規の特別連結」理論を導入できないことになろうが、狭義の「強行法規の特別連結」の考え方によれば、そもそも抵触法的指定とは別次元の問題であると考えられるため、わが国においても一つの理論として導入しうるものと考えられる。このような概念整理を行ったうえで、わが国におけるこれからの議論につなげていく必要があろう。この研究成果は、本学の紀要である『法学』1999年第5号に掲載される予定である。
