项目摘要

本研究においては、わが国において展開されている民事手続上問題となっている主要な論点について、諸外国における法状況を概観し、最適な解決策を提言することにある。法のグロバリゼーションは、実体法のレベルばかりでなく、手続法のレベルにまで拡大しており、とりわけ、欧州連合における通貨統合に向けて努力されてきた法統合の動きは欧州裁判制度や手続法の解釈論の展開に大きな影響を与えている。その中心は、欧州連合の牽引車であるドイツであり、判決手続、執行法、倒産法等の民事手続法全般において強力な国際化政策を展開している。他方、欧州連合の加盟国でありイギリスでは、依然として伝統的な英米法を堅持しつつ、通貨統合や法統合の動きには若干消極的な態度を採っており、隣国とのハーモナイゼーションについても消極姿勢である。いずれにしても、国内判決手続のレベルでは、消費者保護思想に基づく国民に理解できる民主的な司法運営を目指している点は、欧州連合において一定の方向性が見出される。イギリスにおけるかかる傾向についての資料はその性質上ドイツの資料と異なり、かなり複雑な歴史的経緯を経ている結果、今後ともより一層の分析が必要となる。また、現在、ドイツ法の影響を受けている旧東欧圏であるハンガリーの民事手続法およびイギリス法を受け継いだアメリカの民事手続法との比較研究の作業の必要性を認識し、本年度以降においても本研究を継続的に進める方針である。
