项目摘要

本年度は、前年度(平成9年度)に行なった英国・米国・ドイツ等の諸外国の判例・学説等の資料の収集、それらの整理・分析作業を引き続き行なった。その結果、たとえば、諸外国においては、保険会社から保険募集のために雇用されまたは保険募集を委託されている保険募集人と、保険会社から独立して活動する保険仲立人とでは、保険募集に際しての説明義務の根拠が同じではなく、後者においては保険仲立人と顧客の委任契約に基づいて契約上の説明義務・助言義務が生ずると解されているのに対し、前者においてはせいぜい保険募集人と顧客のおかれている状況から信義則上説明義務が生ずることがありうるにとどまること、虚偽または不十分な説明があったために顧客が不利益を被った場合の顧客の救済方法も両者においては同じではなく、保険仲立人の場合には、義務違反による損害賠償責任が保険仲立人に生ずるに止まるのに対し、保険募集人の場合には、損害賠償に加えて、誤った説明の通りの保険契約の成立を認めてこれに基づく保険金の支払をなさしめるという救済もありうることなどが明らかとなった。その後、これらの基礎的作業に基づいて、わが国における具体的問題解決の在り方について検討を進めた。これについては、早晩論文等の形で公表したいと考えている。なお、本研究の一環として、変額保険募集に関する判例研究を一件公表した。
