项目摘要

本年度は、まず、米国・ドイツおよびEUにおける保険事業と競争法の関係について調査研究を行なったが、なかでもドイツでは保険事業について競争法を適用除外とすることの当否について古くから理論的研究がなされていることもあり、本研究においてもこのドイツの議論の調査整理に多くの時間を充てた。続いて、わが国において従来、競争法が保険事業にどのように適用され、また適用がなされなかったのかについて調査を行ない、とりわけ、(1)法形式上は競争法の適用があるにもかかわらず、実際上は適用が排除されているかのごとく扱われている事例、(2)本来保険事業において望ましい行為が、競争法の適用を恐れるがために制約を受けているように思われる事例、について整理した。現在は、以上のような比較法的研究、実証的研究を基礎に、保険事業と競争法のあるべき関係について検討している段階である。上述のとおり、本研究そのものにかかる論文は現在執筆中であるが、本研究の成果の一部は、契約内容登録制度(保険金詐欺を防止するために保険契約の内容を自主規制機関に登録させこのデータを各保険会社が利用するという制度)について論じた論文において公表する予定をしている。

Part of the results of this study is the contract content registration system (the system for the prevention of fraud in insurance funds, the registration of the content of insurance contracts by independent regulatory agencies, and the use of insurance companies).
