文献調査を通じて、本研究が比較法的検討の対象としたアメリカ法では、通常の契約関係では情報提供義務は限定的にしか認められないのに対し、いわゆる信認関係ではそれがヨリ広く要求されることが再確認された。このようなアプローチは、前者が自己利益の追求が許される利己主義的な関係であるのに対し、後者が相手方の利益に配慮することが求められる利他主義的な関係である、という点に由来するのであろう。では、銀行取引は通常の契約関係なのか、それとも信認関係なのか。それがいずれの関係であるかによって、銀行が顧客に対して負う情報提供義務の程度が異なってくることから、銀行取引の性質決定-すなわち、契約関係か信認関係か-が銀行に課される情報提供義務を考えるうえで重要な意味を持つことになる。この点を解明するには二つの方法が考えられる。第一は、信認関係の一般抽象的な定義を確立したうえで、その定義に照らし、銀行取引が信認関係か否か判定いるという演繹的な方法である。ただ、文献調査を通じて、この方法は多数の研究者によって種々の試みがなされているものの、不可能と一般に考えられていることが判明した。そこで、第二の方法、すなわち、信認関係の一般抽象な定義の確立はひとまず断念したうえで、どのような事情があれば裁判上信認関係とされるのか、その個々のファクターを判決例から抽出し、信認関係の具体像に迫るという帰納的方法を採ることにした。関連判決をlexisや他大学図書館の利用により数多く収集し、現在考察を進めているが、同じ銀行取引でも、銀行の当該取引における果たした役割如何で、それが信認関係とされる場合もあれば、そうでない場合もあることを知り得た。この点、来年度も引き続き、ヨリ詳細に検討する予定である。
