昨年度に引き続き、本年度も、主として写本カタログを手がかりに、各種「制定法書」写本の成立事情・内容構成などを検討する作業を行なった。写本カタログは、国内では閲覧できるものが限られているため、9月にイングランドに出張し、オクスフォード大学ボドリアン図書館のデューク・ハンフリー・ルームおよびケンブリッジ大学図書館のマニュスクリプト・ルームに備え付けのカタログを利用した。本研究によって確認されたことは、以下の通りである。13世紀後半に作成された「制定法書」の多くは、マグナ=カルタ(1225年版)に始まり、『令状方式書』、『不出頭理由申立手続書』等の訴訟手続関係の諸解説書、『グランヴィル』、『ブラクトン』、『ブリトン』、『ヘンガム・マグナ』等の法書(断片ないし抜粋のことも少なくない)も含む雑多な集成であり、内容的に重複する部分はあるが、全く同一のものはない。大きさも様々であり、携帯用として実際に利用されていたことを推測させる小型のもの(縦横共10センチ未満)から大判のもの(50センチを超えるもの)まである。「制定法書」として何を含むべきかについての決定的な基準は存在していなかったようである。にもかかわらず、実務的目的のためには有益であったことは疑いない。他方、12世紀に関しては、Assisa, Constitutiones, Carta等と名付けられた立法が残っている。それらを収録した写本集を検討した結果、例えば共に後代に重要な影響を与えたヘンリ2世の立法Constitutions of Clarendon (1164年)とAssize of Clarendon (1166年)は、別系統の写本集中に伝来していることが判明した。前者は教会の文書庫(アラン・オヴ・テユークスベリによる集成、トマス・ベケットのアーカイヴ、ギルバート・フォリオットのアーカイヴ)に由来し、後者はロジャ・オヴ・ホヴデンの『年代記』(BL Royal 14C II)と法集成(Oxford Bodley Rawlinson C641)中に伝来している。なお、これらは13世紀後半には1189年が「法的記憶」(legal memory)の年とされることによって、「制定法書」の中には収録されることがなかった。
