本研究では中世パリ慣習法の基本構造を解明することを目標とし、王令や都市当局が作成した種々の文書などの慣習法を記録した種々の成文資料、パリ市の管轄裁判所である「シャトレ裁判所」とその上級裁判所としての「パリ高等法院」の判決・裁判記録などの資料からパン屋組合関係の資料に対象を絞って分析をおこなった。その結果、パン屋たちの日常の活動をふまえて同業組合の手で多方面にわたる慣習的秩序形成が行われていること、王権・都市当局が首都への食料の安定的かつ公正な供給の観点から普段に介入し、このレベルでも独特の法秩序が形成されること、さらに都市内に存在する教会・修道院などの諸領主の支配領域は独自の秩序空間をなしていること、以上の要素は相互に無関係に並立しているのではなく、相互に関連・影響しあいながら複雑な複合体としてパリ慣習法を生み出していくこと、また、法形態としては慣習法は不文のままで存在すると同時に、それらの不文の慣習法が同業組合規約として成文化される場合や、王権・都市当局による法令の中で既存の慣習として言及される場合、また各種裁判所においておこなわれる慣習法実態聴聞の手続きによって文書に確定される場合があるなど多様な仕方で成文化されたことなども実証的に解明できた。今後は対象を他の業種に広げていくと同時に、中世慣習法分析に儀礼・象徴論的視点を導入する試みを行うことを計画している。
