本年度の科学研究費の対象となった「国際裁判の発展史に関する研究」は,これ以前から調査を進めていたこともあり,ほぼ予定の研究を遂行することができた。この研究は,現在,本研究者が進めている国際司法裁判所(The International Court of Justice)の裁判制度の研究における導入部に該当する。本研究者は,現在,国際司法裁判所の裁判制度に関する体系的学術書を準備中であり,本年度の研究成果は,この体系書のなかに含めて刊行発表するつもりである。本研究(国際裁判の発展史)については,その発展史を,(1)ギリシャ・ローマ時代,(2)中世ヨーロッパ,(3)近代の国際社会,の三期に大別し,それぞれの発展の特色を探究しつつ,現代の国際裁判の史的位置づけを明らかにするように努めた。その際,(3)の近代の発展については,とくに詳しく論ずることとした。本年度のこの研究については,単に資料の調査・分析だけでなく,ほぼ原稿を書き終えることができた。なお先に述べた国際司法裁判所の体系書は,最後の部分の原稿が未完成であるが,今年中にそれを脱稿し,明年には刊行できるように,出版社との必要な打ち合せを済せている。
