知的障害のある人が虐待や放火事件などの事件・犯罪に巻き込まれ被害者および加害者として裁判に関わる事例が我が国においても多く報告されている。近年、知的障害者においても正当な裁判を受ける権利が議論され始めたが、一方実際の法廷では学術的検討や心理学的裏付けがないままに知的障害者の証言や自白・供述内容が放置あるいは不当に処されているのが現実である。本研究のテーマは知的障害のある人の目撃および証言能力および質問に対する回答特徴を明らかにすることであり3年間の研究期間を設定した。一年目の今年度は第一の課題として知的障害者の証言能力測定に関する妥当な研究方法について検討を行った。検討方法は事例分析および直接インタビューによる回答内容の分析とした。事例分析としてはK事件の被害者の支援や裁判過程を通して得られた、被害者本人の過去に対する記憶や質問に対する回答特徴、および支援過程の進行に伴う心理的変化と言及内容の相違についてエピソード記録の分析を中心に行った。結果、・知的障害のある人の知的能力あるいはコミュニケーション能力の測定については療育手帳判定および知能検査による評価に加えて長い実生活体験による言及能力を加味する方法が必要であった。・実際の被害経験者においては質問形式(オープンあるいはクローズドクエスチョン)による回答の相違に加えて被害者の被害経験および今後の裁判進行などの状況理解が回答内容に影響を持つことが示唆された。直接インタビューによる検討では知的障害のある人に対するビデオ視聴および過去体験の言及における質問方法と回答特徴を分析した。質問形式は説明要求型質問4つおよび誘導的質問によった。今後は回答傾向を分析しながら適切なインタビュー技法検討の視点を抽出することが課題である。
