Research on lntellectual Propercy relating to Multi-media and Digitization

最近，随着计算机和电信技术的飞速发展，所谓的多媒体社会已经为人们所熟悉。然而，有人认为现行的知识产权法与多媒体技术带来的影响不相适应，可能会阻碍多媒体社会的发展。在本研究中，我认为“数字化”是多媒体的关键技术，我考察了适合数字技术和网络使用的理想规则是什么。第一章分析了多媒体带来的主要问题，并以“数字化权利”为核心概念。第二章通过对几个发达国家法律的比较，探讨了道德权利特别是人格完整权的问题。在第三章中，我讨论了如何以及在多大程度上保护在网络上传播的作品。重构数字世界的版权，适当重视作品的“使用”而非复制。第四章考察了合同法在网络交易或经济贸易中的适用问题。第五章论述了多媒体终端用户的经济利益和隐私保护问题。第六章讨论了目前引起关注的一些道德问题，包括网络运营者的责任问题。

Recently, with the rapid development of computer and telecommunication technologies, the so-called multi-media society has become familiar to people. However, it is considered that current intellectual property law is not fit for what multi-media technologies will bring and that it might deter the growth of multi-media society. In this research, viewing that "digitization" is the key technology of multi-media, I examine what the desirable rules fitting for digital technology and the use of network will be.Chapter 1 is devoted to the analysis of principal issues caused by multi-media, focusing "digitizing right" as a key concept. In Chapter 2, an issue of moral right, especially a right of integrity is discussed under the comparison of laws of several developed countries. In Chapter 3, I discussed how and to what extent the works transmitted on the network should be protected. Restructuring the copyright in digital world with the proper weight of "use" of works rather than reproduction of them. In Chapter 4, the issues of contract law are surveyed, when applied to network transactions or economic commerce. Chapter 5 is devoted to the issues presented for the protection of economic interest and privacy of end-user of multi-media. In the last Chapter 6, some moral issues currently attracting the concem are discussed, including the network operators liability.
