项目摘要

今年度の研究と実績しては、第1に国際私法(相続)についてのもの、第2に、ウィーン統一売買法についてのもののほか、第3に、本重点領域研究の計画研究B班の研究への寄与を挙げることができよう。第1に、国際私法の分野では、相続に関するルールを詳細に検討することで、この点における実定法知識の構造の解明をある程度図ることができたと考える。その直接の成果、すなわち法律エキスパートシステム構築のための資料となるチャート図等はまだ公表の段階にいたっていないが、間接的な成果として、後掲(「11.研究発表」参照)の論文等の執筆を行った。第2に、ウィーン統一売買法の分野では、計画研究B班との緊密な共同研究体制のもとで、特に適用に関する構造に関してチャート図を作成した。これによって、適用につき、全体の流れが明らかになり、この点についての法律エキスパートシステム構築の一応の基礎はできたのではないかと考える。なお、このような研究の過程で、いくつかの検討課題が浮かび上がってきた。たとえば、代理人を使って売買契約を結んだときの当事者の営業所(第1条)とは何を意味するのか、第95条の留保宣言は法廷国によるものかそれとも準拠法国となるべき国によるものなのか、などの問題である。これらの問題については、平成5年8月の重点領域全体の研究会で私が報告し参加者との議論を行うことで、ある程度の解明はできたように思う。第3に、本年度の私の研究成果として、計画研究B班の研究への寄与を挙げることが許されよう。すなわち、同班の研究会等への参加、適用の部分についての研究の分担等を通じて、B班と私とは相互に有益な刺激・示唆を与えあうことができたのではないかと思われる。
