とりわけ連邦最高裁で同性婚の権利に関するObergefell判決が下されて以後、アメリカ憲法学において司法判断の理由付けにおける世論の援用に関する議論の活性化が見られてきたが、2022年度はそれ以前からの議論も含めてアメリカ憲法学で司法審査における世論の援用がどのように論じられているのかを探究し、その内の一つとして生ける憲法論の代表的論者であるデイビッド・ストラウスが提唱する「現代化」アプローチに着目した。この議論は司法判断において世論が占める位置を検討するものであり、「現代化」とは伝統及び過去の知恵に敬譲するのではなく、裁判所が世論の変化を考慮に入れて、あるいは予期さえして法理をアップデートすることとされ、過去ではなく現在および未来に着目するものとされる。「現代化」の第一要素として、もはや世論を反映していない、あるいは世論の傾向が反対する方向に動いているときに、裁判所が制定法を違憲無効とすることが挙げられ、しかし同時にその第二要素として裁判所は、もし人々の感情を誤って計測したことを見出したときには、すなわち政治過程が無効とされた法律を再び制定するという反応をしたときには、退却する用意をしなければならないとされる。この議論はあくまで一例であり、他の論者の議論を手がかりとして批判的視点を持ちつつ検討を進めた。2023年度前半にはこれらの内容をまとめて一橋法学（査読有）に論文を投稿することが予定されている。
