项目摘要

本研究は、近世ドイツという戦争が継起する「平和なき」時代における、法学識者による軍事、戦争に関する法的議論について、とりわけ「軍法」という議論枠組みとその内容およびその法学理論的、社会的背景の解明を行う。近世法学が法学方法論などの点で近代法学とは異質であることは夙に指摘されてきたが、社会的背景、とりわけ近世における戦争、軍事の比重を増した国家形成との関連における近世法学の性質の解明は殆どなされていない。本研究は近時の歴史学・法史学の研究成果を踏まえ、軍法の「学問化」という視角から近世法学の特質を解明する。2022年度には、16世紀半ばの法学識者の戦争法論との比較から同時代のドイツの法学識者の軍法論の位置づけを明らかにするとともに、一橋大学所蔵「16-18世紀法学文献コレクション」の調査結果を踏まえ、18世紀の大学法学部における軍法関連講義の実施状況（ケーニヒスベルク、ゲッティンゲン）と照らし合わせつつ、18世紀プロイセンにおける軍法学（jurisprudentia militaris）の形成とその背景の解明を進めた。この結果、①近世ドイツの法学識者の軍法論は軍隊内部の規律を法として理解し、正戦論に重点がある戦争法論とは重点が異なっていたこと、②18世紀前半のプロイセンでは軍法務官制度の確立およびその学識化と並行して大学での軍法関連講義の増加、法学学位論文を通じた、近世法学の一分野としての軍法学の形成が認められること、③従来、近世の法分野としての軍法学はドイツ私法学の下位分野であり、19世紀初頭の近代法学の公私法二元論の成立によりその地位を失ったと指摘されてきたが、本研究の成果によれば、私法学の下位分野としての軍法学という議論は18世紀後半のピュッターの法学体系に由来し、これが浸透・制度化したことで、法学の一分野としての軍法学という考え方（②）が退潮したことが示唆された。
