项目摘要

討議を通して得られた共通理解および問題点は次の通りである。1.生命倫理諸問題を(ことに医療の現場を)、我々は人間が人間と向かい合い、言葉と行為のやり取り(コミュニケーション)をしていくという現場で、考えるべきであって、それを抜きにどのようなルールが必要かつ適当かを論じても、倫理学の議論にはならない。2.告知の是非・生命の維持(prolongation)かQOLの向上かの選択・自己決定かパターナリズムかの選択等、問題がディレンマの形をとって現わくる場合を典型的問題として分析を進めると、問題は次の二つの次元から成っていることが分かってくる。(1)「人は他者に対してどのように振舞うべきか」という問題次元(カントの定言命法はこの次元におけるものに数え上げられよう)。これに関して実践の現場では通常イ)「相手にとって最善のことを為せ」とロ)「相手の意志を尊重せよ」という原則が提示される(それらはコミュニケーションというものの基本的性格に由来すると清水は主張する)。医療の現場において、イは当然のこととされてきたが、いまやInformed Consentや自己決定の問題としてロが強調されつつある。(2)イが原則だとして、ハ)「では、この状況でこの人にとって何が最善か」が、真に問題となる。例えばターミナル・ケアの現場に典型的に見られるように、医療側は単に病気という側面のみならず、患者の人生ないし人格全体を考慮して、ハを問わざるをえない状況におかれる(新田はハの場面でも「本人の意志・希望」が基準になると主張する)。そこで、ハに焦点を絞って平成元年度の科学研究費を申請中である。3.清水は63年度後半に4回、東札幌病院における「生命倫理研究会」において発表を行ない、医療者との擦りあわせを行ないつつある。いずれ、成果をまとめて出版する予定である。
