親は公教育制度の全体構造のなかでいかなる位置を占め、子どもの学校教育についてどのような権立をもっているのか。たとえば、親は憲法上の基本的人権として「親の教育権」を保障されており、それに基づいて学校教育の場面でも、教育運営参加権や共同決定権といった積極的な権利を有しているのか。この問題は公教育法制の基本構造にふれる問題だと見られるが、わが国においてはこれについての法制は著しく不備であるし、研究もほとんどなされていない状況にある。本研究は、この領域の教育法制が既にかなりの整備を見ているドイツについて、(1)親の教育権の法的構造、(2)親の公教育運営への参加制度とその運用実態を、理論的・実証的に分析・検討することによって、わが国の学校教育における親の法的地位の明確化とその制度的現実化のための法制論の構築に資する知見を得ようとするものであり、以下のような研究を行った。(1)ドイツにおける親の教育権の法的構造に関する理論的考察ドイツにおける親の教育権の法制史を実証史を実証的に把握した。そして、現行法制下における親の教育権について、その法的性質・内容・国の教育権能や学校の教育権限との関係、公教育法制における位置づけなどについて、実定法制・学説・判例を検討し、考察した。(2)ドイツの父母評議会の法的構造に関する調査研究ドイツ各州の学校参加法、父母評議会の組織・運営に関する法律・学校父母評議会規程など各種の親の教育参加関係法を収集・分析した。また文部省、州・県父母評議会、校長会、教員組合、教育研究者などに質問紙を郵送して、親の学校教育参加の法的構造と運用実態・課題等について調査し、分析した。

(2)A survey of the legal structure of the parent council, a collection and analysis of state school participation laws, laws relating to the organization and operation of parent councils, regulations of parent councils, and laws relating to the educational participation of various parents. The Ministry of Education, Prefectural Government, and Provincial Parent Council, Principal Council, Teacher Association, and Educational Researcher conducted research and analysis on the structure, application, and problems of the school education participation method.
