学校において生徒はいかなる権利を有し、義務を負うのか。伝統的な学校特別権力関係論が説くように、生徒の基本的人権に対する大幅な制約・校則による広範な生徒義務づけは、学校教育の本質上、当然のことなのか。この問題は学校教育法制の基本構造にふれる問題だと見られるが、わが国においては、これについての法制は著しく不備であるし、また教育行政学や教育法学などの学問分野においても未だペンディングな課題に属していると言えよう。そこで本研究は、この法域の「先進国」であるドイツとの対比において、わが国の生徒法制(論)を実証的・理論的に分析・検討し、学校における生徒の法的地位の明確化とその制度的現実化のための法制論を構築しようとするものであり、以下のような研究を行った。(1)学校における生徒の法的地位に関する日独の比較法制(論)的考察:わが国とドイツにおける生徒法制史を実証的に把握したうえで、現行法制下における生徒の法的地位について、学校在学関係の法的性質、いわゆる学校特別権力関係論の当否、学校の教育(運営)権と生徒の権利・親の教育権との関係、学校組織・権限関係法制における生徒の位置づけなどについて、日独の実定法制・学説・判例を検討し、考察した。(2)ドイツの生徒代表制の法的構造および校則に関する調査研究:(1)ドイツ各州の学校参加法、生徒代表制の組織・運営に関する法律、生徒代表制規程など生徒の学校教育への参加関係を収集・分析し、また文部省、州・県生徒評議会、校長会、教員組合、教育研究者などに質問紙を郵送して生徒の学校教育参加の法的構造と運用実態・課題等について調査し、分析した。(2)フランクフルト、ベルリン、ミュンヘン市内の中等学校(30校)の校則を収集し、「生徒の権利と責任」という観点から分析した。

(2)Research on the Structure of Student Representative System Law and School Rules:(1) Collection and analysis of state school participation laws, organization and operation of student representative system laws, regulations of student representative system, student participation relations in school education, Ministry of Education, state student council, principal council, teacher association, educational researchers, questionnaire paper, structure and application of student participation law in school education, etc. (2)The school rules of the city's secondary schools (30 schools) are collected, and the students 'interests and responsibilities are analyzed.
