金融機関をめぐる犯罪には多種多様の形態が存在し,そうした行為に対する規制もまた多種多様になされている。また,そのような不当な経済活動に対する社会の評価も近年大きく変化し,厳しくなってきている。そのような状況の中で,不当な経済行為の実態をもふまえて,「金融犯罪」を再構成し,今後,不当な行為を刑事法上どのように規制すべきかを明らかにするという本研究の目的に従って,本補助金の交付を受けた昨年7月中旬以降に行った結果は次の通りである。主たる作業として,(1)他の研究者等へのインタヴューを通して,金融取引及び金融犯罪の現在の動向の把握及び検討,(2)金融取引を規制する多様な刑罰法規に関する文献・資料の調査,(3)主たる刑罰法規の各論的検討及びそれらに共通する要素の抽出,(4)これまでの「金融犯罪」,「経済犯罪」,「経済刑法」をめぐってなされてきた議論の整理等を行った。その結果,(イ)刑罰法規の保護法益という観点からみれば,金融犯罪とされる刑罰法規には複数の,しかも(具体的なものから抽象的なものまで)さまざまなレベルの法益が存在することが多く,さらに,それらの関係が曖昧なままにされているうえ,個々の法益の内容自体明らかでないことが多く,このままでの保護法益のみによる画一的な,金融犯罪の体系化は困難であり,むしろその本質を見誤る危険をも含んでいる,(ロ)刑罰法規が存在しても,実際の取引では脱法行為が数多く存在するため,構成要件は,現実の不当な取引の規制には必ずしも適切なものではない場合が多いことが明らかになった。そこで今後は,(イ)に関して,特に抽象的な法益の意義を再検討し,体系化に資する意味づけを行うべく努力すると共に,(ロ)に関して,実際の法規の適用(運用)状況を考慮に入れた上で,「金融犯罪」の構造の把握に努めることとしたい。
