1978年のスペイン憲法は、1949年のボン基本法(現行ドイツ憲法)の影響下で制定された。1970年代半ばに、スペイン、ポルトガル、ギリシャでは、独裁制が終わり、自由民主化改革が始まった。この改革は、1989年前後の東欧市民革命と比較できる。フランコ旧体制下では、自給自足経済から開かれた市場経済へ変化した結果、政治体制も西欧化した。東欧市民革命では、経済的破綻が政治改革をも必要とした。1976年に成立したUCD(民主中央同盟)のスアレス内閣は、与野党協調路線を取って、政権への支持基盤を固めた。特に憲法制定に際しては、各党の少数の代表者計7名からなる「特別(起草)委員会」が妥協案作成に貢献した。この点で、ボン基本法制定時の3人委員会と同じ役割を果たした。またスペイン憲法制定時には、単純多数の賛成のみならず、圧倒的多数の賛同が計られた。この点でドイツのヘッセン州憲法制定時の多数派工作の実態と同じであった。1982年に成立したPSOE(スペイン社会労働党)のゴンサレス内閣は、保守層の支持獲得に腐心して、NATO残留政策を選択した。だが、50%以上の議席数の支持を得たゴンサレスの強力な指導力に足して、「議会野党」は精彩を欠いていた。D・L・ガルリイドは、両内閣と議会の権力構造を、象徴的な政治機構図に描いた。また、U・リ-ベルトは両内閣と議会の強弱関係を分析した。リ-ベルトによれば、1976年のスアレス内閣は「(政府)と対等な議会」の範疇に属する。他方、1982年のゴンサレス内閣時のスペイン国会は「政府に従属する議会」であった。ドイツで生まれた「建設的不信任投票制度(後任の首相の選出と現首相の解任を同時に行う制度)」がスペイン憲法113条に輸入され、スアレス少数政権下では政治の安定が計られたのである。
