本年度は1863年から1864年にかけて心理医学会Societte medico-psychologiqueで行われた、「部分的責任」にかんする議論を中心に検討した。この議事録は同年の心理医学年報に掲載されている。ここでは、部分的責任という言葉でなにが理解されるのか、臨床的に部分的な責任を問える精神病をどのように診断すべきかといった問題や、そもそも部分的責任を認めることができるのか否かといった問題が議論されている。この議論の背景には、1820年代なかばにジョルジェによって提起されて以来大きな影響力をもったモノマニ-学説が1850年代にはいりその当否が疑問にさらされたのち、このモノマニ-論によって確保された、医師の刑事裁判における鑑定人としての地位をいかして守ってゆくかという医師の社会的地位の向上をめぐる戦略上の対立があった。一方では部分的責任を認めることでこの鑑定人としての立場が危うくなるのではないかという危惧があり、また一方では部分的責任を認め、こうした犯罪者専用の精神病院を創設することによって医師の活動の場を確保しようとする考え方もある。しかしながら、ここでの部分的責任をめぐる議論の共通枠組はすでに古典的な刑法学説を越える面がある。モノマニ-論は古典的な刑法学説を前提に議論されていたが、この部分的責任をめぐる議論のなかで、世紀末の実証主義的な犯罪学へとつながるようなかたちで、責任論や刑罰論といった刑法の根本問題を、医学的な思考を基盤として再構成しようとする考え方も注目を集めた。以上の成果の一部は1995年10月8日の法制史学会第43回研究大会において報告され、また1996年度の『京都学園法学』掲載予定の論文で詳しく論じられる。

This year, from 1863 to 1864, the Societte medico-psychologique was conducted in the center of discussion on "partial responsibility." The proceedings were published in the same year's Annual Journal of Psychiatry. However, part of the responsibility is to be understood, part of the clinical responsibility is to be asked, part of the responsibility is to be diagnosed, part of the responsibility is to be recognized, and part of the responsibility is to be recognized. The background of this discussion is that in the 1820s, it was raised and the influence was greatly influenced. In the 1850s, it was raised and questioned. The position of a physician in criminal justice is different from that of an expert. One party is partially responsible for recognizing the position of the appraiser and ensuring the activities of the physician. Some of them are responsible for the discussion of the common group of classical criminal law theory. On the premise of classical criminal law theory, on the responsibility of some parts, on the criminology of evidence-based theory at the end of the century, on the responsibility theory, on the fundamental problem of criminal law, on the basis of medical thinking, on the reconstruction of the foundation, on the basis of examination, on the focus of attention. One of the above achievements was presented at the 43rd Research Conference of the Legal History Society on October 8, 1995, and the 1996 Kyoto Academy of Law published a detailed discussion of the paper.
