まず、わが国生活保護にかかる行政実態および現象の把握のために、被保護者の生活実態に関する種々の調査報告、争訟事例の諸資料、地方公共団体の報告書、職員に対するヒアリング等をつうじて情報収集に努めた。その際、裁量統制という見地から、事務処理の過程、内部指針ないし準則の内容、個々のケースにおける運用実態をとくに重視した。ドイツ公的扶助行政については、行政実態に詳しい日本で入手可能な文献のほか、直接現地の地方公共団体および社会福祉法人の連合体等に赴き、ヒアリングおよび資料検索・収集を行った。同時に、公的扶助にかかる膨大な裁判資料の収集に努めた。このようないわばミクロの視点での作業のみならず、わが国およびドイツの公的扶助政策さらに社会保障政策の変遷とその構造的要因との連関を探るというマクロの視点での検討のための資料をできる限り収集した。とりわけドイツにおいては東西統一ならびに深刻な経済不況を前に、従来の公的扶助制度を根底から変える大改革が具体化されている段階にあったので、その最新情報を現地より入手することに努力した。以上の作業から得られた知見について、わが国およびドイツの一般的な裁量統制にかかる行政法総論の既存の成果に基づいた視角・手法で考察した結果、従来わが国では広範な裁量に委ねられるにとどまっていた生活保護行政について、ドイツ環境行政で形成された手法が有益であることに加えて、公的扶助領域に即した統制枠組・手法、すなわち扶助基準設定過程と専門機関の組織構成とそこでの審議手続のあり方、実体的統制原理としての必要充足原則・個別性原則の活用、需要の種類と程度との二元的考察、地方公共団体による給付要綱の定立をつうじた給付の一律化・類型化と個別事情への配慮義務が、実効的な裁判的統制として機能し得ることが明らかとなった。これらの成果については、「研究発表」欄記載の論文で詳述した。
