Social Self-Organization and Legal Control

当前的环境风险问题，单靠行政指挥和控制是解决不了的。有必要做到企业自愿管理自己的环境风险。在这些认识的前提下，本项目旨在研究日本企业如何挑战ISO140001。本研究的另一个目的是为法律控制与社会自组织之间的一般关系找到理论起点。我积极研究了日本企业对ISO14001的态度。我将问卷发给了大约270家ISO14001审核企业，并走访了多家企业和审核机构。结果概要如下。大多数企业在ISO14001审核中加强了环境管理部门。但目前尚不清楚他们是否会将其结构转变为更开放和反思的结构。他们倾向于考虑法律和条例的法律控制。这在理论上是一个非常有趣的现象。他们往往担心环境管理系统的成本会增加。

We cannot deal with the problems of today's environmental risks by the administrative command and control. It is necessary to do it that the businesses manage their own environmental risks voluntarily. On the premise of these understanding, this project aims to research how the Japanese businesses challenge the ISO140001. Another aim of this research is to get the theoretical starting point for the general relationship between legal control and social self-organization.I researched the Japanese businesses' attitude for ISO14001 positively. I sent the questionnaire to about 270 businesses with ISO14001 audit and went to several businesses and auditing organization. The outline of the result is following.1. Most businesses reinforced the environmental management section at ISO14001 auditing. But it is not clear yet that they change their construction to the more open and reflexive.2. They tend to take account of the legal control of law and ordinance. This is the very interesting phenomenon theoretically.3. They tend to be afraid that the cost of environmental management system will increase.
