本研究は、(1)日本及びドイツの少年事件の弁護活動の実状、特に、社会福祉援助活動の具体例を収集・整理し、一般化の可能性を探るとともに、その理論化を行うこと、(2)少年事件弁護活動における法律的援助と非行克服を目指した社会福祉援助の相互関係を法治国家原理と社会国家原理の関係として統合的に把握する理論を構築することを目的とする。そのために今年度は、以下の研究を行った。(1)日独の少年事件弁護活動に関する試料収集を昨年に引き続き行った。日弁連の経験報告集を収集・分析するとともに、ドイツのケルンで開催された少年弁護に関する研究集会の報告書の通読、論点の整理を行った。この成果は、しかるべき時期に、紹介したいと考えている。(2)少年事件に関与する実務家との研究会は、昨年に続き、今年度は5回開催した。そのテーマは、「矯正と保護の連携」「福岡の子どもの意識と実態調査」「『被害者問題』と少年法」「現代の青少年と家族」「少年が被害者と向き合うとき-修復的司法の試み」となっており、少年非行の社会的背景とその援助のあり方並びに少年に対する援助と被害者に対する援助の関係が重点テーマとなった。次年度は、これらの検討をふまえ、付添人活動と社会資源の開拓あるいは少年援助機関との相互連携について共同研究をしていきたい。
