项目摘要

欧米諸国においては既存住宅の維持管理・増改築が盛んであり、日本でも、今後既存住宅の維持管理・増改築による環境の改善と創出が徐々に大きな位置を占めてくるものと思われる。しかしこのような場合、土地及び建物各部の所有及び利用に関する権利関係が大きな障害になることは明かである。こうした住環境にまつわる権利関係の内容及びその法的根拠等は各国の歴史的背景や住宅政策のあり方の影響を受けているが、その内容と住環境改善における権利調整の手法について、国際的に比較し得る基礎資料は伴っていない。そこで本調査では、近い将来のハウジングのあり方を考える上で意義が大きいと思われるこうした権利調整手法に関する国際共同研究を目指し、その方法及び資料収集の可能性等の調査を行い、実現性と成果達成可能性の高い研究企画を立案した。まず、企画調査の詳細な計画及び調査すべき項目の設定について、各研究分担者が収集している既往関連研究の検討等に基づきながら討議、決定した。さらに主として、各研究分担者が有する海外研究者・行政機関とのネットワークを利用し、各国における権利形態とその調整手法に関する資料体の有無及びその名称・入手可能性を調査するとともに、次段階の国際共同研究において研究分担者となる可能性・必要性の高い研究者をリスト化した。以上の検討の結果を国際国際比較調査項目一覧及び共同研究分担者候補リストとしてまとめた。次年度以降の国際共同研究の計画を具体的に立案した。
