本研究では、第一に、人権保障のため機能する既存の国家機関とは別個の公的機関で、憲法または法律を設置根拠とし、人権保障に関する法定された独自の権限をもち、いかなる外部勢力からも干渉されない独立性をもつ機関である、国内人権機関の制度化の動向として、国連の「国内人権機関の地位に関する原則」(パリ原則)を検討した。第二に、「アジア太平洋地域国内人権機関フォーラム」による取り組みを検討した。(1)1996年にダーウィンで開催された「人権の伸長と保護のための国内機関の第1回アジア太平洋地域ワークショップ」、(2)1997年にニューデリーで開催された「第2回アジア太平洋地域国内人権機関ワークショップ」、(3)1998年にジャカルタで開催された「アジア太平洋地域国内人権機関第3回年次会合」およぴ、(4)1999年にマニラで開催された「第4回年次会合」での論議の概要、地域協力の課題を検討した。第三に、アジア各国の国内人権機関の概要として、インドの国内人権委員会、スリランカの人1権委員会、フィリピンの人権委員会、インドネシアの国内人権委員会の、設立経緯、根拠法令、組織、権限と機能を検討した。そして、間題点として、次の4点を明らかにした。すなわち、(1)国内人権機関の独立性を確保するためには、憲法上または法律上の根拠が必要である。(2)構成の多元性と職権の独立性は、強力で効果的な国内人権機関の最も不可欠な要素である。委員の任命も社会の多元性を反映したものに改善されるべきである。(3)人権機関の管轄権は、軍を対象にするように拡大されるべきである。(4)機関の任務の範囲は、それぞれの政府によって与えられる人権の定義に基礎づけられ、限定されている。市民的、政治的権利だけではなく経済的、社会的権利の侵害に関する調査権も付与されるべきである。

This study focuses on the functions of existing state organs, other public organs, constitutional laws, legal restrictions on the protection of human rights, external forces, independent organs, and the institutionalization of domestic human rights organs. The "Principles Concerning the Status of Domestic Human Rights Organs"("Principles") of the State Council are discussed. Second, the "lost Pacific region domestic human rights organizations" in the selection of group discussion (1) In 1996, it was launched as the "First Annual Meeting of the Domestic Organizations in the Pacific Region";(2) In 1997, it was launched as the "Second Annual Meeting of the Domestic Organizations in the Pacific Region";(3) In 1998, it was launched as the "Third Annual Meeting of the Domestic Organizations in the Pacific Region";(4) Summary of discussions and discussion of regional cooperation issues at the opening ceremony of the Fourth Annual Meeting in 1999. Third, the summary of the domestic human rights organs of the countries concerned, the discussion of the functions of the domestic human rights committee, the national human rights committee, the establishment of the system, the implementation of laws, organizations and regulations. The next four points are clear. (1) Ensuring the independence of domestic human rights institutions is constitutionally and legally necessary. (2)The most indispensable elements of the domestic human resources organization are the diversity, independence and strength of the organization. The appointment of members reflects the diversity of society. (3)Human resources agencies are responsible for the development of human resources. (4)The scope of agency responsibility is limited to the definition of government responsibility. The investigation of civil and political interests and violations of economic and social interests shall be carried out in accordance with the relevant provisions of this Law.
