本研究は領域権原の機能と限界を探るものである。その作業の一環として、本年度は(1)国際司法裁判所(ICJ)における領域関連紛争の分析、(2)資料収集、(3)それら資料を分析する際の方法論の模索を行った。具体的には、(1)1986年のブルキナファソ=マリ間の国境紛争事件を端緒として90年代・2000年代においてICJに付託される領域関連紛争は激増しており、最近の判例を中心に、データベース作成作業を行った。(2)新たな領域紛争の傾向を位置付けたブルキナファソ=マリ間の国境紛争事件の訴答書面を入手することができ(オランダ・ハーグ・国際司法裁判所文書部所蔵)、さらに国際司法裁判所法務部職員へのインタビューも行った。(3)これら作業に並行し、領域紛争に色濃く影響を及ぼす植民地主義について、また国際法学における歴史の意義について検討した。以上の分析から、近年の領域紛争において頻繁に用いられる「effectivites」概念と、領域紛争の古典とされるパルマス島事件(1928年国際仲裁)における「主権の表示」概念とのずれが認識された。両者はほぼ同じ文言にもかかわらず、その機能が異なる。前者が領域支配の根源的正当化根拠としての権原にあるのに対し、後者は現状承認原則(Uti Possidetis)に対する補助的権原にあるに過ぎない。このような概念の変容がどのように行われたかという問いは、近年の領域紛争が背景としてもつ植民地主義の歴史が関連している。本年度の研究実績によって、本研究は、植民地主義という国際社会の負った歴史的遺産を国際法学がどのように受容してきたのか、そしてある法概念がどのような基盤に拠って機能し得るのかというより一般的な問いへの可能性を拓いた。

This study explores the original function and boundary of the domain. This year, we conducted (1) analysis of domain related disputes in the International Court of Justice (ICJ),(2) data collection, and (3) methodological modeling of data analysis. Specifically,(1) the 1986 border dispute incident began in the 1990s and 2000s, and related disputes in the field entrusted by ICJ have increased in recent cases. (2)The tendency of disputes in new fields is to pay attention to the written answers to disputes between countries. (3)This article discusses the significance of international law in the field of science and technology. The above analysis shows that the concept of "effectivites" has been frequently used in recent years. The same is true of the same language, and the same is true of different functions. The former is the root cause of domain domination, and the latter is the root cause of subsidization. The concept of land ownership is related to the history of land ownership in recent years The achievements of this year's research are aimed at exploring the possibility of the inheritance of the negative history of the international community and the concept of international law.
