16年度は、独占禁止法における複数企業による独占の規制をEC法を中心に研究した。寡占的市場における事業者の協調的行動を規制するには、15年度の研究対象であったカルテルの規制による方法と複数事業者による独占(協調的寡占)として規制する方法がある。行為者の行動の分析を中心とするカルテルの規制と異なり、違法な協調的寡占の認定においては、市場構造の分析を中心に、協調的行動を行った事業者の結びつきを示す状況証拠が導き出される。この結びつきの認定について、判例においては、資本関係のない完全に独立した事業者間の結びつきはまだ認められておらず、どの程度の結びつきが認められれば違法な協調的寡占とされるのかが問題となる。判例で市場に協調的寡占をもたらすおそれのある合併等も禁止している結合規制も参考にすれば、以下の条件が満たされれば協調的寡占が認定されるといえる。市場参加者の数が少なく、市場参入障壁が高く、または生産量を増大させるための障壁が高く、核に強調的行為が行われており、価格の交差弾力性が低く、商品の差別化が進んでおり、生産費用、垂直的統合の度合い及び企業規模が類似しており、市場に一匹狼的な事業者が存在せず、市場が発展段階を過ぎ、安定期に入っており、有力な買い手が存在しない場合である。これらのほか、規模の経済性、埋没費用の大きさ、市場の透明性等が考慮される。これらについては理論上両極端な結論が導き出されるため、個別事例ごとに詳細な分析が必要となるが、分析の結果明白な回答が得られる保証はない。そのため現段階では、状況証拠から結びつきが認定される場合は非常に限定されており、それも、事後的な協調的寡占の規制ではなく、事前規制である結合規制に限られている。
