1 本年度も前年度に引き続き刑事法廷の観察と弁護人に対する面接調査を各地で行った。2 まず中国地方と四国地方に管轄をもつ裁判所の刑事法廷において、どのような刑事弁護活動が行われ、また、どのような性格の弁護士が弁護人を務めているのかを、各地の刑事裁判を傍聴することによって観察した。これにより、各裁判所により裁判官や検察官の配置が異なり、係属事件の性質や傾向、事件負担の軽重も具体的に考慮に入れながら、刑事裁判の訴訟指揮、公判立証活動、公判弁護活動の特色を記録することができた。3 そして、現在法廷活動を行っている弁護人全員を対象にして、刑事弁護に関する経験や印象、執務環境や業務基盤などを職歴上の変遷を交えながら面接調査により聴取した。これにより、各地の弁護士の刑事弁護活動に対する継続的関与が、国選弁護制度と当番弁護士制度によって支えられ、比較的多くの弁護士に刑事弁護の事件負担を分散させていることが判ったが、地域の事件配布制度の差異や弁護士の個性によっては、一定の弁護士に刑事弁護事件が一部偏る傾向が見受けられた。4 今後の被疑者国選弁護制度や裁判員制度の導入による弁護負担増加に対する展望としては、この間に弁護需要は増大してきているものの、弁護士人口の漸増により最低限の弁護役務を供給できてきたので、弁護士会や弁護士個人や法律家団体側で独自の新態勢の確立をめざす見解は少なかった。よって、今後も本研究のような各地域の弁護実務の実態調査を民事分野でも重ねることを通じて、外部または市民の立場から客観的に弁護役務の需要と供給の状況を精確に調査したうえで法的サービスの供給制度を考察していくことが必要である。
