1 昨年度からの研究を踏まえ、多元的法体制論から法のポストコロニアル研究へと至る理論的展開を検討した。その成果は、『法社会学』誌に論文「多元的法体制はいかに認識されるか?-ミクロネシア連邦ヤップ州の海域紛争における「伝統と慣習」-」としてまとめられた。この論文では、多元的法体制論から法のポストコロニアル研究への理論的展開のなかに、国家法中心主義への偏重傾向が見られると指摘した。さらに、人々の日常的実践に対する国家法のイデオロギー支配という理論図式を本質化してしまっている点を批判した。そして具体的な紛争事例の分析を行い、国家法のイデオロギーに必ずしも囚われない、人々の生活実践における国家法の多元的リアリティを実証的に示した。2 国立民族学博物館の共同研究「脱植民地期オセアニアの多文化的公共圏の比較研究」(研究代表者・宇都宮大学教授 柄木田康之)の共同研究員に選出された。「他文化公共圏」をキーワードとするこの研究会の会合において、法の多元性を公共性の多元性の問題としてより広く検討する必要性が示唆された。3 この新たな課題に取り組むべく、ミクロネシア連邦ヤップ州で現地調査を行った。従来から追跡してきた海域紛争裁判の事例の経過を追うなかで、法の要請するのが均質的な公共性であるのに対して、現地の人々の考える公共性は不均質なものであるとの印象を持った。この印象を裏づけるべく、収集したデータを整理した上で、上記研究会で次年度以降発表する予定である。4 また、法人類学勉強会を再開させ、翻訳出版を目指すという目標のもと、海外における法人類学関連の重要著作をいくつか選出した。具体的な活動は次年度以降に行うこととなった。
