项目摘要

本研究では、ネットワーク外部性が働く産業におけるネットワーク間相互接続や技術互換性について理論的・実証的に検討した。本年度の主要な作業は次の通りである。第一に、知的財産制度の存立理由、その諸側面、運用についての、これまでの主として法学、経済学からの研究を概観し、知的財産権の配分がどのようにネットワーク外部性の働き方に影響を与えるかを整理した。第二に、ネットワーク効果はしばしば技術標準に起因していることに鑑み、技術標準の成立過程についての理論的分析を進めた。技術標準が重要であり、かつ複数の企業が持つ技術が標準を構成するような産業では、多くの場合、クロスライセンスやパテント・プール等を通じた技術の融通が行われているが、必須技術の一部が研究開発専業企業によって開発される場合には、研究開発専業企業は自社技術について高額のライセンス料を他社から求める誘因を有する。本研究ではこのような状況で採られるべき政策を検討し、研究開発専業企業に対して標準に必須な技術については低廉なライセンス料率で技術をライセンスさせる政策を採ることが、標準成立の確率と社会厚生を引き上げる場合があることを示した。第三に、ネットワーク外部性が働く場合には、企業による積極的な行動がなくても特定の企業が大きな市場シェアを獲得する場合があることに鑑み、このような状況で採りうる政策を検討した。これに関連し、競争政策と知的財産制度全般について概観し、どのような場合に両者の間で緊張が生じ得るか、その際にどのような調整手段が用いられるかを整理した。
