本研究は、自白の任意性をめぐる争いを適切に解決するための方策を、諸外国の経験や実績に学びつつ、法理論的および法政策的見地から検討しようとするものである。初年度の研究に引き続き、本年度も、我が国における、自白の任意性をめぐる審理手続の現状に関して、実務法曹と意見交換する機会を設け、取調べ状況の録画・録音制度の意義と課題につき、検討を加えた。周知のとおり、同制度の導入に対しては、捜査実務家から、事案の真相解明に著しい困難を来すとの反対があるが、そこで指摘される弊害の内容・範囲に照らして、被告人や事件の特性(被疑者が少年か、外国人か、知的障害はないか、また、否認事件か否か、など)に応じた取調べ状況可視化の方策を探ることの重要性を確認した。その一方で、比較法的検討のための文献収集・分析を継続し、英国・アメリカ合衆国(連邦法域、州法域をともに含む)を対象として、その実体法のあり方にも照らして、我が国の手続につき考える上で適切な前提を共有しているか、などの点を踏まえつつ、両国(法域)が、いかなる考慮に基づいて、現在の制度・運用に至ったのかを跡づけることに重点を置いて研究を行い、捜査において取調べの有する意義・比重、取調べ状況の録画・録音が被疑者の供述に及ぼす萎縮効果に対する評価、適正手続保障の意義・内容に関する理解の違いなどの要因が、取調べ状況の録画・録音の導入をめぐる議論に影響を及ぼしていることを確認した。なお、身柄拘束中の被疑者にっいても問題となる、徹夜の、長時間にわたる取調べについて検討した、「在宅被疑者の取調べとその限界(三)」(法學71巻2号掲載予定)では、被疑者の取調べに対する同意の有効性とならび、そこでなされた供述の任意性の立証が、訴訟の中で、重要な、しかし、解決の容易でない問題となり得ることを念頭に置いて、取調べ過程の可視化の方策が特別に講じられていない現状において、その判断に際して着目すべき事項を摘示することに努めた。
