本業績「提訴前手続きにおける相手方の協力義務に関する一試論」(香川法学27巻3・4号65頁)では、迅速な裁判手続の実現には、提訴前の段階を含めた証拠収集手続が重要な意義を持つということを前提とし、提訴前の証拠収集手続において、相手方に証拠収集に応じるべき義務を課すことができるかという問題について考察を行った。民事訴訟法は、平成8年の改正以降に証拠収集手段の拡充を図ってきた。このなかで、提訴前及び提訴後の照会、提訴前の証拠収集処分等が新たに設けられた。しかし、これらの手続において、情報や証拠を有する相手方がなぜ手続に応じなければならないのか、という問題についての理論的な検討は不十分なままであった。そのため、実効性が期待できないこの手続の利用は芳しくない。本業績は、このような状況について、証拠収集手段の拡充のためには、これらの手続において相手方の協力義務を理論的に基礎づける必要があることを主張している。そのうえで、提訴後において証明責任を負わない相手方が協力すべき義務として従来論じられてきた、事案解明義務をめぐる議論を参考として、提訴前の証拠収集手続における相手方の義務を導き出すことを試みている点に本業績の意義がある。すなわち、本業績は、提訴後に証明責任を負わない相手方が主張・立証過程で協力すべき義務と結びつけて、この義務を相手方に課しうるか否かの判断の際に、提訴前手続において協力義務を果たしていたかを遡及的に判断することを唱えている。このように提訴後の時点で遡及的に判断を行うことで、提訴前の段階だけでは大きな義務違反の効果を生じさせることができないという従来の課題も解決可能となる。今後、この理論的基礎づけにより提訴前の証拠収集手続の利用が進めば、より迅速な裁判手続が期待できることから、本業績は、この問題についての議論の契機として、迅速で適正な裁判の実現にとって意義を有する。
