项目摘要

本研究の目的は、英仏百年戦争終結後(15世紀後半〜16世紀)のフランス王国において、王権が王国諸地域の自立性と多様性にどのように対応したのかを解明することにより、前近代フランス「国家」を支えた統合原理を析出することである。具体的には、当時、次々と王領に併合された諸侯国の裁判機関や法が、どのように変質したのかというテーマを設定した。今年度は、諸侯国の裁判機関がいかにして国王裁判所に統廃合されたかという問題から、旧諸侯国地域に高等法院(王国の最高裁判所)が設立されたいくつか地域の事例を検証した。このなかから、史料が豊富に残るブルゴーニュ公領に対象をしぼり、王領への併合過程と高等法院の設立経緯を刊行されている国王文書の分析を通じて検討し、受入機関内の研究会において報告した(裏面【学会発表】)。一王国内に最高裁判所をいくつも設置するという王権の試みは、「集権・分権」という近代的な基準で叙述されてはならず、それは王国の行政単位の母体となる地域枠そのものを創出した試みであったと指摘した。また、当該期の諸侯裁判権を特徴づけたフランス同輩特権の問題にも着手した。この特権は、当時の王国諸侯に授与された最高貴族の称号であり、諸侯が当事者となった紛争ならびにその支配領域からの上訴は、下級・中級の国王裁判所を飛び越して、直接パリ高等法院に管轄された。同輩特権に関する研究は少なく、そこで諸侯国からパリへの上訴手続が実際にどのように行われたかを、具体的な紛争事例を通じて検討し、複数の報告を行った(裏面【学会発表】)。とくに西洋史研究会においては、「中世王権と聖俗貴族-紛争の解決とアイデンティティー」という共通論題のもと、他の西洋諸国との比較を意識して、同輩特権が王国指導層としての諸侯の責務と不可分であったことを指摘し、王国諸地域のパリへの従属度の高さを中世末期フランス国制の特質として提示した。
