本研究は、大学設立の背景と法学との関係、および大学で法学を学んだ学生の進路を、1450年以前(第1期)と以後(第2期)を比較しつつ、調査しようとするものであった。中世後期ドイツの大学は、すべて君候ないし都市によって創建されたものであるが、その際、法学を修めた官史の自国での育成などといった「実用的」目的だけでなく、設立諸侯の家門の威信向上や都市間の対抗関係といった広く「政治的」な動機を無視できないことがわかった。この傾向はとりわけ第1期により強く見られる。また特に第1期には、設立時の大学の財政的基盤整備や人的資源供給の面で、カトリック教会との非常に密接な関係が存在し、それを反映して法学教育でも教会法が重要であった。こうした性格は、第2期には、大学数の増加により大学が「地方化」したことで、幾分やわらいだと考えられる。学生のその後の進路は、特に第2期については、史料の刊行状況などに制約されて、量的な把握は困難であった。全般的傾向としては、まずそもそも法学部の学生は他学部に比して身分の高い者(貴族や上層市民)が多く、出生によって地位を約束された彼らの学位への執着は必ずしも強くなかったのであって、学位を取得せずに大学を離れる者が極めて多かった。学位取得者の進路としては、特に第1にはやはり教会が重要であり、大学教師のポストも全体としての教会キャリアに組み込まれていた。しかし、15世紀前半には既に世俗君主の顧問の中に学位保持者を見いだすのが珍しくなくなり、第2期の終わり頃には供給過剰をうかがわせる現象もみられた。またドイツで多くの大学が成立した後も、なお法学教育はドイツでは完結せず、多くのドイツ人学生がイタリアの諸大学を訪れ続けた。

This study compares the background of university establishment and the relationship between law, university law, student path, before 1450 (the first period) and after 1450 (the second period).
