本件研究においては,情報・サービスが横領罪,詐欺罪,電子計算機使用詐欺罪などの刑法典の財産犯処罰規定において,いかなる範囲で保護されているかについて,解釈論的な見地から,包括的な検討を加えた.その結果,たとえばデジタル情報の不正取得の類型などについては,現行法においても財産犯としての処罰が可能であるが,財産犯としての性質決定を行う以上,その処罰には一定の限界があることが明らかになった.さらに不正競争防止法などの特別法における保護について分析しつつ,立法論として,望ましい保護の在り方について,検討を加えた.

This paper studies the crime of cross-possession, fraud, computer fraud, property crime punishment provisions of the Criminal Code, and explains the theory of cross-possession, including fraud. As a result, the type of incorrect information obtained is different from that obtained by the existing law, and the punishment for property crimes is possible. The nature of property crimes determines the behavior of the above, and the punishment is limited to a certain extent. The Law on Prevention of Unfair Competition shall be amended by special laws for protection, analysis, legislative discussion, hope for protection, and discussion.
