本研究の目的は、わが国の住民参加プロセスにおける紛争が、米英国などで多くの実践の蓄積がある仲裁、調停、あっせんなどの紛争管理手法を援用することによって、どのように解決できる可能性があるのかを明らかにすることである。本研究では、まず、紛争管理について、土木計画学、政治学、社会学、公共哲学、社会心理学分野等の既往文献を基に議論し、わが国における紛争管理の考え方や、有効であろう具体の手法、適用方法等を理論的に検討し、提案する。そして、提案する紛争管理手法の効果の確からしさについて先行事例の関係者及び紛争解決の専門家を対象としたヒアリング調査、及び仮想シナリオ実験に基づき検証する。研究初年度は、以下の研究を行った。(1)紛争管理に関する概念整理土木計画学、政治学、社会学、公共哲学、社会心理学等の分野における紛争管理に関わる学術文献及び実務向けガイドブック等を基に、概念整理を行った。(2)国内外の紛争管理に関する事例収集・整理日本及び米国の紛争管理事例における紛争の経緯及び適用した紛争管理手法に関する資料を収集・整理し、多様な紛争管理手法の実務上の効果や適用上の課題などについてヒアリング調査を行った。(3)本研究の「社会資本整備における紛争管理の考え方」の検討(1)、(2)を踏まえ、本研究における紛争管理の目的・定義、紛争管理の視点・手法、紛争管理手法適用上の利点と限界等を検討し、「社会資本整備における紛争管理の考え方」の素案を作成した。

The purpose of this study is to explore the possibility of dispute resolution by means of arbitration, mediation and dispute management techniques. This study is based on previous literature on dispute management, civil planning, political science, sociology, public philosophy, social psychology, etc., and provides theoretical discussion and proposal on dispute management methods. The effectiveness of dispute management techniques is determined by the relationship between the prior case and the related parties to the dispute resolution, by investigation, and by the evaluation of the basis of the dispute management technique. In the first year of the study, the following studies were conducted. (1)Conceptualization of dispute management in civil planning, political science, sociology, public philosophy, social psychology, etc. (2)Case collection and collation of dispute management in Japan and the United States Case collection and collation of dispute management in Japan and the United States Case collection and collation of data on dispute resolution and application of dispute management methods, practical results of multi-dispute management methods, and application of issues.
